Training on the regulation of public procurement

Design, preparation and organisation of a training session on the regulation of public procurement, for 16 executives from the Autorité de Régulation des Marchés Publics ARMP (Public procurement regulation authority) in Benin. This session took place in La Rochelle (France), from 20 to 24 April 2015.

Its objective was to enable the executives to:

- understand the issues of regulation for the development of economies;

- know about the various actors involved in regulation.

Topic 1 - The issues of regulation - History and definition of the economic regulation concept:

- Sectoral regulation and deregulation.

- Regulation and supervision of the economic markets.

- The methods of exercising regulation: self-regulation, State, Agencies, High Council, Regulation Authority.

- The actors of regulation: the executive government, the regulator, economic operators, users, clients or beneficiaries, and authorities.

Topic 2 - The extent of the regulator’s powers - Regulation and powers to issue opinions, to make proposals, to impose sanctions and regulatory powers, general case and case of ARMPs:

- Regulatory powers in the context of national, community and international texts.

- The means of regulation: information, monitoring and specific inspections.

- The independence of the regulator.

Topic 3 - The relationship between the regulator and the judge:

- The law of economic regulation and competition.

- The balance between powers and the reconstruction of power relations.

- The binding force of regulation and the safeguard of fundamental rights.

Institut Forhom was entrusted with the preparation and educational organisation of this one-week session. Training was given by an expert trainer in the regulation of public procurement.

The purpose was to provide very operational training, so as to address as much as possible the participants’ daily concerns and meet their expectations within the framework of their duties.
