The review of legality

The Forhom Institute was entrusted by LUX DEV to prepare and facilitate in Ségou (Mali) a 5-day training session for 6 prefects, 12 sub-prefects from the Ségou region and several agents from the Directorate General of Local Authorities (DGCT). This training course was facilitated by a Civil Administrator from the French Ministry of the Interior and by a Malian Consultant, formerly Secretary-General of the Malian Ministry of Territorial Administration.

The detailed programme of the week-long training session was as follows:

• Contemporary institutional history of Mali, from colonial administration to the June 2015 Peace Agreement.
• A reminder of essential concepts: What is the purpose of reviewing the legality of the acts of local authorities? What's the current state of decentralisation in Mali?
• Current situation of local authorities in Mali from the perspective of professionals.
• Focus on the review of the legality of the acts of local authorities, as amended by the law of September 2017.
• Review of the legality of the acts of local authorities in France since 1982.
• Relations between central departments of government and local authorities.
• Information, advisory support, review of legality and supervision.
• Administrative justice in Mali.
• Roles of central government with regard to legality review and litigation.
• Implementation: the tricks of the trade.
• What's the current state of decentralisation in France?
• Overview of Central-Local government relations in other African countries.

Participants were given a practical framework to help them implement the review of legality in their respective constituencies, and assist their colleagues and subordinates in such tasks.
